PAIA Manual

1. Introduction

This manual is published by Seknd Nature Private Cannabis Collective in compliance with section 51 of the Promotion of Access to Information Act, 2 of 2000 ("PAIA"). It sets out what records the collective holds, how to request access to them, and the grounds on which a request may be refused.

3. Information Officer

4. Records held

Published on this website — no request needed

Available to the member concerned, on request

  • Their own membership record, application and approval history
  • Their own orders, invoices, payments and loyalty statement
  • Audit-log entries relating to their own account

Signed-in members do not need to submit a formal request for these: a complete export is available under Account → Privacy & data.

Restricted

  • Records belonging to other members (third-party privacy)
  • Internal operating procedures, supplier and operator contracts
  • Financial, tax and banking records beyond the requester's own payments
  • Records held under a legal hold or relating to an active investigation

5. How to request access

  • Use Form 2 prescribed under PAIA, available from the Information Regulator at inforegulator.org.za.
  • Send the completed form to hello@sekndnature.com, or by post to the address in section 2.
  • Describe the records clearly and give enough information to identify yourself.
  • Prescribed PAIA fees may apply. A member's first request for their own personal records does not attract a fee.
  • We respond within 30 days of receipt (section 25). That period may be extended once by a further 30 days (section 26), and we will tell you if it is.

6. Grounds for refusal

A request may be refused on the grounds in Chapter 4 of PAIA, including:

  • Mandatory protection of the privacy of a third party (section 34)
  • Mandatory protection of commercial information of a third party (section 36)
  • Mandatory protection of confidential information (section 37)
  • Records protected by legal professional privilege (section 40)
  • Manifestly frivolous or vexatious requests (section 45)

7. Remedies

The collective is a private body, so PAIA provides no internal appeal. A requester who is dissatisfied may ask the Information Officer to reconsider, and may then apply to the Information Regulator for review under section 77A before approaching a court.

8. Languages

This manual is published in English. A translation into another official South African language will be provided on reasonable request, where reasonably practicable.
